Gift of Wellness – Terms and Conditions
The following are the terms and conditions applicable to TriVita Inc. Gift of Wellness Gift Cards.

Redemption.

Premier Membership and VitaPoints
- VitaPoints cannot be applied against shipping, handling or taxes.
- VitaPoints cannot be converted to cash value and are non-transferable.
- VitaPoints can be used in conjunction with other discounted specials and with auto-delivery.
- VitaPoints will expire 12 months after redemption from the Gift Card. TriVita may modify the program with shorter or longer periods.
- VitaPoints are available to accounts in the U.S. and Canada. A point equals the smallest base currency unit for that account (1 point = 1 CAD or USD penny). Expansion to other countries will follow local base-unit standards.
- VitaPoints may be earned and redeemed cross-currency. Point values are based on the active conversion rate at the transaction date.
- Returned products automatically deduct the VitaPoint value. Negative balances may occur and do not expire.
- Accounts may earn up to 60,000 Referral VitaPoints (USD equivalent) per calendar year. Excess points are forfeited but still recorded. Loyalty earning is otherwise unlimited. This applies to programs involving services rendered to TriVita.
- TriVita may run promotions awarding additional VitaPoints. Gift Cards may be redeemed only for eligible goods and services on TriVita.com. Gift Card purchases convert into VitaPoints upon redemption and exclude shipping, handling and taxes. Unused Gift Card value becomes VitaPoints in the redeemer’s account. If a purchase exceeds the Gift Card balance, the difference must be paid using another method. To view your VitaPoints, visit MyAccount.TriVita.com. No fees apply.

Limitations.
- Gift Cards cannot be used to purchase other gift cards, reloaded, resold, transferred for value or redeemed for cash, except as required by law. Unused balances cannot transfer between accounts.

Risk of Loss.
- Risk of loss and title passes to the purchaser upon electronic transmission to the recipient or delivery to the carrier. TriVita is not responsible for lost, stolen, destroyed or unauthorized use of Gift Cards.

Fraud.
- TriVita may close accounts and charge alternative payment methods if a fraudulently obtained Gift Card is redeemed or used on TriVita.com or affiliated platforms.

Limitation of Liability.
- Gift Cards are provided without warranties, express or implied, including merchantability or fitness for a particular purpose. If a Gift Card is non-functional, TriVita’s sole liability is replacement. Some jurisdictions do not allow warranty limitations or damage exclusions; in those cases, these limitations may not apply.

Disputes.
- All disputes relating to Gift Cards will be resolved by binding arbitration, except qualifying small-claims matters. Federal arbitration law applies.
- An arbitrator may award the same individual relief a court could, but review is limited.

Arbitration will be administered by the American Arbitration Association (AAA). Filing fees for claims under $10,000 will be reimbursed unless deemed frivolous. Arbitration may occur by phone, writing or in person in your county or another agreed location. - Disputes must be handled individually — not as class, consolidated or representative actions. If a claim goes to court, both parties waive jury trial rights. Either party may seek court injunction to protect intellectual property.

- TriVita may change these terms at any time at its discretion. Terms apply as permitted by law.
