TriVita, Inc. Affiliate Program Terms & Conditions Agreement

Welcome to the TriVita Inc. Affiliate Program. This Agreement outlines the terms and conditions for participating in our affiliate program. By signing up as an affiliate, you agree to comply with the terms and conditions set forth in this Agreement.

TriVita’s mission is to help people experience greater wellness through our quality products and services. The TriVita Affiliate Program (TAP) allows experienced e-commerce marketers and influencers to earn commissions from new customer acquisitions and reorders of those customers.

The TAP program and commissions for sales of TriVita products are applicable exclusively in the U.S.A.; however, approved Affiliate participants may reside outside of the U.S.A.

Article I
Acknowledgment

1. Upon acceptance from TriVita, requirements for the TAP are as follows:
   1. Must be at least 18 or the age of majority in your jurisdiction.
   2. Must be of legal capacity to form a binding agreement.
   3. Adherence to the policies herein.

Article II
Affiliate Link

After acceptance by TriVita of your application, you will be provided a unique trivita.com affiliate link to promote TriVita products through your marketing efforts.

To earn commissions on purchases made from customers that came from your marketing efforts, you must use this link to track and earn commissions.

Any new customer who places a product order from your link will be automatically linked to you for 18 months without placing a second order. If the customer does not place a second order after the 18-month time period, the customer will be unlinked from your TAP account. Each purchase a customer places that is linked to you will start a new 18-month linkage period.

Article III
Promotion Limitations and Restrictions

You will not engage in any promotional activities on behalf of TriVita that are not permitted under these policies. The use of TriVita trademarks and/or product names is prohibited in all marketing.

Exception: You may mention or use the trademark “TriVita” and “TriVita.com” when TriVita provides approved marketing materials for a specific campaign.

1. When using any TriVita trademarked brand or product name, it must be published as a live link directed back to trivita.com. Example: trivita.com/nopalea.
2. Product testimonials from the website and catalog are available for use in promotions but may not be edited or altered. New testimonials must be approved by TriVita.
3. Engaging in fraudulent activity, such as click fraud, cookie stuffing, or unauthorized promotional methods, is strictly prohibited.
4. You must comply with all applicable laws, regulations, and guidelines, including FTC guidelines for endorsements and testimonials.
5. No spam, unsolicited emails, or deceptive/unethical marketing practices are permitted.
6. Misrepresentation of TriVita’s products or making income claims is prohibited. All information must be accurate and honest.
7. You may not use TAP in a manner that violates any law or acts deemed harassing, harmful, hateful, or obscene.
8. TriVita may delay or refuse commissions if fraudulent or dishonest activity is suspected. TriVita’s decisions are final and binding.

Article IV
Application

1. The TAP application is free. You must complete all information requirements, including how you will promote TAP.
2. Applications will be reviewed within 5 business days. You will be notified of approval or denial via the email you provided.
3. Applicants must show proof of marketing or influencer experience and explain how they plan to promote TriVita.

Article V
Commissions

Earn 50% commission on the sale of the first purchase from all new referred customers.

Residual commissions are paid as follows:

1. First-sale commissions are calculated weekly and paid within 3 business days of the following week.
2. Residual commissions are calculated monthly and paid within 10 business days of the following month.
3. Commissions are based on the product sale total, excluding taxes, shipping, and discounts.
4. Products with higher manufacturing costs may have reduced commission rates (see Affiliate Portal for details).
5. Therapeutic products do not pay the 50% first-sale commission.
6. No commissions are paid on personal affiliate purchases.
7. Commission sharing is prohibited. You may not purchase through your own affiliate link or create self-linked accounts.
8. Customer returns or cancellations will result in commission deductions or forfeitures.
9. All commissions are paid via PayPal in U.S. dollars.

Article VI
Taxes

All taxes related to income or benefits from TriVita are the affiliate’s responsibility. TriVita does not withhold or remit any federal, state, or municipal taxes. Year-end 1099 statements are provided for U.S.-based affiliates.

Foreign affiliates are responsible for reporting their income according to their domestic tax laws using PayPal or portal reports.

Article VII
Indemnification

Disclaimer: TriVita assumes no liability for any matter relating to the creation, maintenance, or operation of an affiliate’s content or platform. You agree to defend, indemnify, and hold harmless TriVita, its affiliates, employees, officers, and representatives from any claims, damages, or costs arising from your content or actions under this program.
